3. Medical Services and Telemedicine

3.1 Nature of Services

Erect Direct Now is a telemedicine platform that connects patients with licensed healthcare providers. We facilitate consultations and prescriptions but do not provide medical advice directly. All medical decisions are made by independent, licensed physicians.

3.2 No Doctor-Patient Relationship with Erect Direct Now

Your doctor-patient relationship is with the prescribing physician, not with Erect Direct Now. We are a technology platform and pharmacy facilitator, not a medical practice.

3.3 Truthful Information Required

You must provide accurate, complete, and truthful information in your medical consultation. Providing false information can result in:

  • Inappropriate prescriptions that may harm your health
  • Denial of future services
  • Account termination
  • Potential legal consequences

3.4 Not for Emergency Care

Our services are not appropriate for emergency medical situations. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.

3.5 Limitations of Telemedicine

Telemedicine consultations have limitations compared to in-person visits. By using our services, you acknowledge that:

  • The physician cannot perform a physical examination
  • Diagnosis may be based solely on your self-reported information
  • You may need to follow up with an in-person healthcare provider
  • Our services are not a substitute for comprehensive medical care

4. Prescriptions and Medications

4.1 No Guarantee of Prescription

Completing a consultation does not guarantee that you will receive a prescription. The physician will only prescribe medication if they determine it is medically appropriate and safe for you.

4.2 Medication Information

All medications carry potential risks and side effects. You are responsible for:

  • Reading and understanding all provided medication information
  • Following dosage instructions carefully
  • Reporting any adverse reactions to your healthcare provider
  • Consulting a physician if you have questions or concerns

4.3 Drug Interactions

You must disclose all medications, supplements, and health conditions in your consultation. ED medications can have dangerous interactions with certain drugs, particularly nitrates and some blood pressure medications.

4.4 Prescription Validity

Prescriptions issued through our platform are valid for the duration specified by the prescribing physician and applicable state law. You may not transfer, sell, or share your prescription medications with others.

5. Orders and Payments

5.1 Pricing

All prices are displayed in U.S. dollars and include the cost of medication and shipping. Prices are subject to change without notice, but you will always see the final price before completing your purchase.

5.2 Payment

Payment is required at the time of order. We accept major credit cards and debit cards. By providing payment information, you authorize us to charge your payment method for all fees incurred.

5.3 Billing

You are responsible for all charges associated with your account. If payment fails, we may suspend or cancel your order.

5.4 Subscription Services

If you enroll in a subscription plan:

  • Your payment method will be charged automatically at the subscription interval
  • You can cancel at any time through your account settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial subscription periods

6. Shipping and Delivery

We ship to addresses within the United States and its territories. Shipping times are estimates and not guaranteed. We are not responsible for delays caused by:

  • Incorrect shipping addresses provided by you
  • Customs or regulatory holds

You are responsible for providing an accurate shipping address. We cannot reship orders delivered to an incorrect address due to your error.

7. Returns and Refunds

7.1 No Returns on Prescription Medications

Due to FDA regulations and safety concerns, we cannot accept returns of prescription medications once they have been dispensed and shipped.

7.2 Refunds for Denied Consultations

If your consultation is not approved by a physician, you will not be charged for the medication. Any consultation fees paid (if applicable) are non-refundable.

7.3 Defective or Incorrect Products

If you receive a damaged, defective, or incorrect product, contact us within 30 days for a replacement or refund. We may require photographic evidence of the issue.

8. Account Responsibilities

You are responsible for:
